These Terms of Use ("Terms") govern your use of the RunBeat mobile application ("App") operated by Mushin Labs, LLC ("we," "us," or "our"). Your license to use the App is governed by Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). These Terms supplement that agreement with terms specific to RunBeat; if the two conflict regarding the license, Apple's agreement controls. By using RunBeat, you agree to these Terms. These Terms should be read alongside our Privacy Policy.
1. Description of Service
RunBeat is an audio-first heart rate zone training app for iOS with an optional Apple Watch companion app. The App receives heart rate data from Bluetooth Low Energy (BLE) heart rate monitors, Apple Watch, or AirPods Pro 3 (via HealthKit) to provide voice-coached training, and integrates with Apple Music for playlist playback during workouts.
2. Eligibility
You must meet the minimum age required by applicable law in your jurisdiction to use this app. If you are under 18, you represent that you have parental or guardian consent to use the App.
3. Not Medical Advice
RunBeat is a fitness tool, not a medical device. The heart rate data, zone calculations, and training guidance provided by the App are for informational and fitness purposes only. They are not intended to diagnose, treat, cure, or prevent any medical condition.
You should consult your physician or qualified health provider before beginning any exercise program or if you have questions about a medical condition. Do not disregard professional medical advice or delay seeking it because of information provided by the App.
Your use of RunBeat does not create a doctor-patient or any other professional healthcare relationship.
You acknowledge that physical exercise carries inherent risks and that you use RunBeat at your own risk.
4. Subscriptions and Payments
RunBeat offers auto-renewable subscriptions through the Apple App Store. Payment is processed entirely by Apple. We do not have access to your payment information.
By subscribing, you agree to the subscription price and billing frequency displayed at the time of purchase. Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time through your Apple ID settings.
If your subscription begins with a free trial, you will be charged the subscription price when the trial ends unless you cancel at least 24 hours before the end of the trial.
Refund requests are handled by Apple in accordance with their refund policies.
5. Apple Music
RunBeat uses Apple's MusicKit framework to access your Apple Music library for playlist playback. An active Apple Music subscription is required for music features. We do not control Apple Music's availability, content, or service quality. Your use of Apple Music is governed by Apple's terms and conditions.
6. Heart Rate Monitors
RunBeat receives heart rate data from third-party Bluetooth Low Energy (BLE) heart rate monitors and from Apple Watch and AirPods Pro 3 via HealthKit. We do not manufacture, distribute, or guarantee the accuracy of any heart rate monitor or sensor. The accuracy of heart rate data depends on your device, its fit, and environmental conditions.
The optional RunBeat Apple Watch companion app runs a HealthKit workout session to relay heart rate data to the iPhone app. For AirPods Pro 3, the iPhone app itself runs a HealthKit workout session, through which iOS delivers the AirPods' heart rate readings. Your use of HealthKit is subject to Apple's terms and conditions.
7. Permitted Use
You may use RunBeat only for personal, non-commercial purposes and in compliance with applicable laws. You agree not to:
- Reverse engineer, decompile, or disassemble the App
- Attempt to gain unauthorized access to the App's systems or infrastructure
- Use the App for any unlawful purpose
- Reproduce or redistribute the App or its content
8. Termination
We may suspend or terminate your access to RunBeat if you violate these Terms. Upon termination, your right to use the App ceases immediately.
9. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. If a change is material, we will provide notice in the App before it takes effect. Your continued use of RunBeat after a change takes effect constitutes acceptance of the revised Terms.
10. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
11. Notice for California Users
Under California Civil Code Section 1789.3, California users are entitled to the following notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 N.
