These Terms of Use ("Terms") govern your use of the RunBeat mobile application ("App") operated by Mushin Labs, LLC ("we," "us," or "our"). By downloading, installing, or using RunBeat, you agree to be bound by these Terms. If you do not agree, do not use the App. These Terms should be read alongside our Privacy Policy.
1. Description of Service
RunBeat is an audio-first heart rate zone training app for iOS. The App connects to Bluetooth Low Energy (BLE) heart rate monitors to provide voice-coached training and integrates with Apple Music for playlist playback during workouts.
2. Eligibility
You must meet the minimum age required by applicable law in your jurisdiction to use this app. If you are under 18, you represent that you have parental or guardian consent to use the App.
3. Not Medical Advice
RunBeat is a fitness tool, not a medical device. The heart rate data, zone calculations, and training guidance provided by the App are for informational and fitness purposes only. They are not intended to diagnose, treat, cure, or prevent any medical condition.
You should consult your physician or qualified health provider before beginning any exercise program or if you have questions about a medical condition. Do not disregard professional medical advice or delay seeking it because of information provided by the App.
Your use of RunBeat does not create a doctor-patient or any other professional healthcare relationship.
You acknowledge that physical exercise carries inherent risks and that you use RunBeat at your own risk.
4. Subscriptions and Payments
RunBeat offers auto-renewable subscriptions through the Apple App Store. Payment is processed entirely by Apple — we do not have access to your payment information.
By subscribing, you agree to the subscription price and billing frequency displayed at the time of purchase. Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time through your Apple ID settings.
Refund requests are handled by Apple in accordance with their refund policies.
If you reside in the European Union, you may be entitled to a 14-day cooling-off period under local law. By starting to use the App immediately after purchase, you acknowledge that you waive this right.
5. Apple Music
RunBeat uses Apple's MusicKit framework to access your Apple Music library for playlist playback. An active Apple Music subscription is required for music features. We do not control Apple Music's availability, content, or service quality. Your use of Apple Music is governed by Apple's terms and conditions.
6. Bluetooth Heart Rate Monitors
RunBeat connects to third-party Bluetooth heart rate monitors. We do not manufacture, distribute, or guarantee the accuracy of any heart rate monitor. The accuracy of heart rate data depends on your device, its fit, and environmental conditions.
7. Intellectual Property
All content in the App — including text, graphics, logos, icons, audio files, software, and design — is the property of Mushin Labs, LLC and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or reverse engineer any part of the App.
8. Permitted Use
You may use RunBeat only for personal, non-commercial purposes and in compliance with applicable laws. You agree not to:
- Reverse engineer, decompile, or disassemble the App
- Attempt to gain unauthorized access to the App's systems or infrastructure
- Use the App for any unlawful purpose
- Reproduce or redistribute the App or its content
9. App Store
You acknowledge that these Terms are between you and Mushin Labs, LLC, not Apple. Apple is not responsible for the App, its content, maintenance, or support. You agree to comply with the Apple Media Services Terms and Conditions applicable to your use of the App Store.
Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
10. Disclaimer of Warranties
RunBeat is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that heart rate data will be accurate or reliable.
11. Limitation of Liability
To the fullest extent permitted by law, Mushin Labs, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or profits, arising out of or related to your use of the App.
In no event shall our total liability exceed the amount you paid to us in the twelve months preceding the event giving rise to the claim.
12. Changes to the App
We may update, modify, or discontinue any part of RunBeat at any time without prior notice. We are not obligated to provide support, maintenance, or updates, though we intend to continue improving the App.
13. Termination
We may suspend or terminate your access to RunBeat if you violate these Terms. Upon termination, your right to use the App ceases immediately.
14. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of RunBeat after changes are posted constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.
